Penerapan Strict Liability terhadap Keracunan MBG Perspektif Maslahah Al-Dauliyah (State Interests)

Abstract

Poisoning cases in the Free Nutritional Meal (MBG) program have caused public unrest and raised questions about the appropriate form of legal accountability for organizers. In situations where proving fault is often difficult, the principle of strict liability becomes relevant. Through this principle, the responsible party can still be held accountable without first having to prove fault. This study discusses how the principle of strict liability can be applied in cases of poisoning in the Free Nutritional Meal (MBG) program, and how this is viewed from the perspective of Maslahah al-Dauliyah or the interests of the state. In this case, the principle of strict liability is important because the organizer can still be held accountable without first having to prove fault. This study uses a normative legal method by examining relevant laws and legal concepts. The results show that the application of strict liability can provide faster and clearer protection for poisoning victims, while also encouraging program organizers to be more careful in carrying out their duties. When viewed from the perspective of Maslahah Al-Dauliyah, this step is in line with the state's responsibility to protect the safety of society and maintain the public interest.
